Planning and Zoning Commission

The Planning & Zoning Commission is a seven (7) member board that makes reports and recommendations related to the planning and development of the city to the Board of Aldermen. The Commission hears and considers applications such as rezonings, site plans, preliminary and final plats, and certain signs. The Commission meets every second Tuesday of the month.

SECTION 400.010:     COMPOSITION AND COMPENSATION

There is hereby created a Planning and Zoning Commission within the City of Kearney.  The membership shall include the Mayor, if the Mayor chooses to be a member, a member of the Board of Aldermen selected by the Board, if the Board chooses to have a member serve on the Commission.  The Mayor shall select six (6) members from the public at large with the approval of the Board of Aldermen.  All members of the Commission shall serve without compensation.   (Ord. SECTION 400.020:     TERM

The term of each of the members appointed by the Mayor shall be four (4) years except the first (1st) five (5) appointed by the Mayor shall serve for varying periods so that succeeding terms will be staggered.  At the first (1st) meeting of the Commission, the five (5) members shall draw straws to determine the terms of each.  The first (1st) term shall be for one (1) year, one (1) for two (2) years, one (1) for three (3) years and two (2) for four (4) years.  (Ord. SECTION 400.030:     VACANCY

Any vacancy in the membership of the Commission of those appointed by the Mayor shall be filled by the Mayor with the approval of the Board of Aldermen for the unexpired term of the member vacating his/her post.  (Ord. No. 563-91 §3, 12-16-91)

SECTION 400.040:     OFFICERS

At the first (1st) meeting of the Commission, it shall elect from the members appointed by the Mayor one (1) as a Chairman and one (1) as the Secretary.  Such officers shall serve for one (1) year and shall be eligible for re-election.  (Ord. No. 563-91 §4, 12-16-91)

SECTION 400.050:     MEETINGS -- RULES -- RECORD

The Commission shall hold regular meetings and special meetings as provided by rules to be adopted by the Commission.  The Commission shall keep a record of its proceedings which shall be public records of the City of Kearney.  (Ord. No. 563-91 §5, 12-16-91)

SECTION 400.060:     QUORUM

A majority of the membership of the Commission shall constitute a quorum for the transaction of business.  (Ord. No. 563-91 §6, 12-16-91)

SECTION  400.070:     REMOVAL FOR CAUSE

The Board of Aldermen may remove any citizen member for cause stated in writing and after public hearing.  (Ord. No. 563-91 §7, 12-16-91)

SECTION 400.080:     POWERS

The Planning and Zoning Commission shall have and perform all the functions of the Zoning Commission described in Chapter 89, RSMo.  (Ord. No. 563-91 §8, 12-16-91)
